Tillaga um breytingu á reglum ISNIC um Úrskurðarnefndina. Markmiðið er að ISNIC geti boðið upp á einfaldari, hraðvirkari og ódýrari málsmeðferð þar sem nægir að einn nefndarmaður yfirfari mál og felli úrskurð. Sé tilefni til má þó fjölga nefndarmönnum í þrjá. Aðrar breytingar eru leiðréttingar.

29. gr. verði Læst lén er sjálfkrafa umskráð á læsingabeiðanda ef læsingarþoli samþykkir að afskrá lénið. Ef læsingarþoli verður ekki við úrskurði eða dómi um að afskrá lénið eða umskrá það á læsingarbeiðanda, getur ISNIC framfylgt úrskurði eða dómi enda sé þess getið í úrskurðar- eða dómsorði Lén sem skráð er á læsingarbeiðanda í framhaldi af sátt, dómi eða úrskurði telst nýskráð frá þeim degi sem breytingin er framkvæmd í kerfi ISNIC. Article 29 (engin breyting)

31. gr. verði Á vegum ISNIC starfar sérstök úrskurðarnefnd sem skal skera úr ágreiningsmálum er varða skráningu léna. Nefndin er sjálfstæð og óháð í störfum sínum. ISNIC framfylgir úrskurði nefndarinnar tíu dögum eftir að hann er felldur eða næsta virka dag þar á eftir láti læsingarþoli það undir höfuð leggjast. ISNIC framfylgir ekki úrskurði nefndarinnar hafi dómsmál verið höfðað vegna sama máls eða lögbann verið lagt á notkun viðkomandi léns áður en niðurstaða nefndarinnar liggur fyrir eða áður en sá dagur sem úrskurði hennar átti að framfylgja á rennur upp. Til nefndarinnar má vísa málum sem varða skráningar .is léna. ISNIC carries out decisions of the Board within 10 days after they have been passed or on the next business day thereafter. ISNIC will not carry out the Board of Appeal's judgements if legal proceedings have been instigated in respect of the same issue or an injunction been placed on the use of the domain in question before the Board of Appeals has reached a decision. Cases involving the registration of domains or refusal to register domains may be referred to the Board of Appeals.

Article 31 verði A Board of Appeals handles disputes regarding the registration of domains. The Board of Appeals is autonomous and independent. ISNIC carries out decisions of the Board within 10 days after they have been passed or on the next business day thereafter, if the current registrant does not accept the verdict. ISNIC will not carry out the Board of Appeal's judgements if legal proceedings have been instigated in respect of the same issue or an injunction been placed on the use of the domain in question before the Board of Appeals has reached a decision. Cases involving the registration of domains or refusal to register domains may be referred to the Board of Appeals.

32. Gr. (núverandi) Nefndarmenn skulu skipaðir af ISNIC. Í nefndinni skulu sitja þrír menn og jafnmargir til vara. Formaður og varamaður hans, sem jafnframt er varaformaður, skulu uppfylla hæfisskilyrði héraðsdómara, sbr. 2. mgr. 12. gr. laga nr. 15/1998 um dómstóla. Einn nefndarmanna skal hafa faglega kunnáttu á sviði samkeppnis- og vörumerkjamála og einn þekkingu á sviði Internetsins og tækni. Skipunartími nefndarmanna er tvö ár í senn. Formaður og varamaður hans skulu skipaðir af ISNIC án tilnefningar, en aðrir nefndarmenn og varamenn þeirra eru skipaðir á grundvelli tilnefningar frá Internetsamfélaginu og Háskóla Íslands. Ritari nefndarinnar skal vera starfsmaður ISNIC. Ritari hefur ekki tillögurétt né heldur rétt til að hafa áhrif á störf nefndarinnar.

32. Gr. verði ISNIC skipar formann nefndarinnar til tveggja ára í senn og skal hann uppfylla hæfisskilyrði héraðsdómara. Formaður úrskurðar einn í málum nema hann telji eðli tiltekins máls og aðstæður að öðru leyti gefa sérstakt tilefni til að úrskurðarnefnd verði skipuð þremur nefndarmönnum við meðferð þess. Skal ISNIC þá skipa tvo nefndarmenn til viðbótar og skal annar þeirra hafa faglega kunnáttu á sviði samkeppnis- og vörumerkjamála og hinn á málefnasviði internetsins og tækni. Ritari nefndarinnar skal vera starfsmaður ISNIC. Ritari hefur ekki tillögurétt né heldur rétt til að hafa áhrif á störf nefndarinnar. Article 32 The members of the Board of Appeals are appointed by ISNIC. The Board of Appeals consists of three members and an equal number of alternate members. The chairman and his alternate, who is also the vice chairman, shall meet conditions normally required for appointment to the Icelandic Supreme Court. One of the members shall have the professional knowledge of competition and trade mark act and one member shall have knowledge of the Internet and Internet technologies. The Board of Appeal shall be appointed for a term of two years. The Chairman and his alternate shall be appointed by ISNIC without nomination while other members of the Board of Appeals and their alternates shall be appointed based on nominations from the Internet community and the University of Iceland. The Board of Appeal's secretary shall be an employee of ISNIC. The secretary has neither the right to submit motions nor the right to influence the work of the Board of Appeals. Article 32 (new) The Chairman of the Board of Appeals is appointed by ISNIC for a period of two years and shall meet the conditions normally required for appointment to an Icelandic district Court. The Chairman normally decides alone in cases, unless he determines that the complexity of a case demands a three member ruling. Then ISNIC shall appoint two extra members were one member shall have the professional knowledge of competition and trademark law and the other shall have knowledge of the Internet and Internet technologies. The Board of Appeals' secretary shall be an employee of ISNIC. The secretary has neither the right to submit motions nor the right to influence the work of the Board of Appeals.
